These Terms & Conditions ("Event Terms") apply to all auctions, live sales, and interactive sales events hosted by MonkandMoon ("we," "us," or "our"). By participating in any event, you agree to these terms in full.

Monk and Moon's rolling auction refreshes with a pool of 30 active lots around the clock. Listings start at $10 or $40 with minimum bid increments of $1. Built-in anti-snipe rules extend the timer if a bid lands in the final minute, ensuring everyone has a fair chance to win!

1. Eligibility & Account Requirement

Participation in auctions and live sales requires:

  • A valid Shopify customer account
  • Acceptance of all required policies, including:
    • Shipping & Returns Policy
    • Damaged Items Policy
    • These Event Terms

Accounts that fail to comply with event rules may be restricted from future participation.

2. Binding Bids & Claims

Auctions:

  • All bids are binding
  • Each bid must increase the current highest bid by at least $1.00 USD
  • Once placed, bids cannot be canceled or retracted

Live Sales:

  • Claims are processed on a first-come, first-served basis
  • Submitting a claim constitutes a binding agreement to purchase the item
  • Once a claim is placed on a live sale item, claims cannot be canceled or retracted

3. Winner Determination: Zero Human Intervention: Our system systematically closes auctions and Live Sales and verifies winners.

  • Notifications: Auctions run for 12 hours, and you will be notified automatically each time you are outbid.  Auction winners are determined automatically when the auction closes 
  • Live sale winners are determined by system order of valid claims
  • All determinations made by the MonkandMoon system are final

4. Draft Orders & Payment Window

When you win an auction or successfully claim an item:

  • Automated Bundling & Invoicing: Once an auction or live sale closes, the system automatically removes the item from inventory and bundles all wins from a rolling 12-hour period into a single draft order
  • Inventory is reserved exclusively for you during the payment window
  • Payment Terms: You will receive one consolidated email with a payment link. Invoices must be paid within 48 hours, or the auction win becomes void.
  • A checkout link will be sent via email and/or other enabled notification methods.

5. Failure to Pay

If payment is not completed within the 48-hour window:

  • The draft order will be canceled
  • Reserved inventory will be released
  • Items may be:
    • Re-listed
    • Offered to another participant
    • Returned to inventory

Repeated unpaid event orders may result in loss of eligibility to participate in future auctions or live sales.

6. Account Restrictions & Bans

  • Strike Policy: Accumulating 3 unpaid invoices will result in your account being permanently blocked from participating in future auctions
  • Restricted customers will be notified of the dates of unpaid events that led to the restriction.
  • Restrictions are enforced automatically and may be reviewed at MonkandMoon's discretion.

7. Final Sale Policy

  • All auction and live sale purchases are final sale.
  • Returns, cancellations, or exchanges are not permitted, except in cases of verified shipping damage as outlined in the Damaged Items Policy.

8. Shipping, Insurance & Damaged Items

  • Most orders ship via USPS Priority Mail, which includes limited carrier insurance
  • Damage claims require complete photo documentation as described in the Damaged Items Policy
  • Claims submitted without required documentation are automatically denied
  • MonkandMoon automatically adds shipping insurance to every order.  A flat fee of 1.5% of the total purchase amount will be charged on every order that we ship, including auction, live sale or regular purchases

    For example:  Your total live sale or auctions wins in a rolling 12 hours have a cumulative value of $120.  A small fee of $1.80 (1.5%) will be included in your shipping fee

    With this insurance coverage you are completely covered in the event that the items get damaged during shipping, your package gets stolen, or for some other reason your package doesn't get delivered etc.

9. Notifications & Communication

By participating in events, you consent to receive:

  • Event-related emails
  • Checkout and payment reminders
  • Optional push notifications or SMS (if enabled)

All notifications will include clear instructions and checkout links when applicable.

10. AI-Assisted Event Management

Auctions and live sales may be moderated or hosted by automated systems or AI-assisted tools.

These systems:

  • Enforce event rules
  • Manage timing, inventory, and notifications
  • Do not have authority to override Event Terms

System records are authoritative in the event of disputes.

11. Technical Issues & Disruptions

MonkandMoon is not responsible for:

  • Internet connectivity issues
  • Device malfunctions
  • Missed bids or claims due to technical problems outside our control

We reserve the right to:

  • Pause
  • Reschedule
  • Cancel events if technical issues arise

12. Changes to Event Terms

Event Terms may be updated periodically.

When material changes occur:

  • Participants may be required to re-acknowledge the updated terms
  • Continued participation constitutes acceptance of the revised terms

13. Governing Law

These Event Terms are governed by the laws of the State of Colorado, United States.
